4 BIG DOGS Terms, Conditions & Privacy Statement – Effective from 1^st January 2021

These Terms & Conditions (T&Cs) apply to all products purchased on this website after 1^st January 2021.  Any products purchased prior to that date are relevant to the prior version.  Please read these T&Cs carefully and fully before proceeding.  If you don’t agree with, or accept these T&Cs, please leave this website now and do not proceed further. 

 

Definitions

“We”, “us” or “our” is defined to mean Words Publishing Pty Ltd T/A 4 Big Dogs, ABN:  55 372 603 906, and postal address of PO Box 5197, Victoria Point, 4165. 

"You" is defined as the user of this website and/or customer of 4 Big Dogs. 

The “website" is defined to mean www.4bigdogs.com.au .

 

Orders & Offers

By placing an order and pressing the ‘confirm’ button you agree to these T&Cs in full.  You further agree that by pressing the ‘confirm’ button that you wish to purchase the products selection in the transaction. 

The website is an invitation to view.  It is not an offer.  Your order will not be legally accepted by us, and a contract will not exist between us and you, until your order is validated internally and verified.  We reserve the right to refuse to fulfil your order.  Payment will not be taken (or will be refunded) in this instance. 

Orders placed on weekends (Saturday and Sunday) or Australian public holidays will not be processed until the following business day (Monday to Friday exclusive of public holidays).

Once your order is accepted, you will receive an Order Confirmation.  When your order is shipped you will receive an additional advice via email.  If for any reason (such as inability to supply) you will be contacted via email or phone.  In this instance, you will be either offered a refund or backorder option or both.  Once your order is processed, you will be emailed a Tax Invoice; this is your proof of purchase. 

Any discounts offered on the site from time to time cannot be backdated.  If you want to make the most of any discounts or specials, get onto our mailing list as we will put out a newsletter prior to any specials – in order to give customers advance notice.  

 

Minimum Legal Age Confirmation

By placing an order, agreeing to the Terms and Conditions, and further accessing this website, you you confirm that you are at least eighteen (18) years of age.  If you are less than 18 years of age, you cannot place an order with us.  This site is not designed or authorized to engage with persons under 18 years of age.

 

Australian Sales Only

We ship products only to locations within Australia and do not supply outside Australia. 

 

Payment Methods

We accept payment via: Visa, MasterCard and PayPal only.

 

Goods & Services Tax

All items listed on the website include 10% goods and services tax (GST).

 

Delivery Times

We will display the estimated delivery time for your product/s on the checkout screen, although generally, please allow 15 business days (excluding weekends and Australian Public Holidays) from time of order confirmation.  We use either Australia Post or for larger items a courier may be selected.  Delivery is to metro areas.  If you are on a rural property, farm or remote area, this is not classified as metro.  If the item is returned, then return shipping and a 20% restocking fee will apply.

Australia Post or the Couriers will deliver to the address you have specified as your "Shipping Address" on your order.  If they are unable to deliver, the item will be returned to us.  Upon receipt of the returned item, in good condition, and upon request, we will return your purchase price, less the return shipping and the 20% restocking fee.  Please see our Force Majeure clause herein.   

 

Errors & Omissions

While we make every attempt to list accurate and current product information and pricing, there may be the occasional typographical error or omission. We cannot be held liable for such errors. We reserve the right to refuse to honour an order based upon any misunderstanding arising from such error.

 

Prices & Products are Subject to Change

Prices and product listings are subject to change without notice. We reserve the right to change details on our website without notice.  Any order placed and paid for at a pricing level will be honoured at that level at time of order placement. 

 

Order Cancellations

We strongly encourage you to choose carefully and only place an order once ready and happy to purchase.  Once your order has been put through, but BEFORE it is shipped, you can cancel your order.  You will be refunded your purchase price, less a $33 admin fee.  Should you wish to change your order, first cancel the first (by contacting us at woof@4bigdogs.com.au) and then place a fresh order for the alternative item you wish.  We cannot simply ‘swap’ an item and refund/charge the difference. 

 

Returns

We recommend that you carefully choose before buying as returns are not available purely because you changed your mind or are unhappy.  If the package is damaged upon receipt, be sure to take photos of the package, before you unwrap it and then photograph any product damage as a result of the damaged packaging.  Please then email us at woof@4bigdogs.com.au with your invoice, photos and a description of what has occurred.  Be sure to include a contact phone number, should we need to call you. 

 

All products have a three (3) month warranty, however DAMAGE BY DOG/S CHEWING OR OTHER SUCH PRODUCT ABUSE WILL NOT BE COVERED UNDER WARRANTY.  If the item is received defective, we ask you to contact us at woof@4bigdogs.com.au and provide your invoice, photos of defect and description of defect. 

In the case of returns or defects you may be required to return the goods. 

You may visit the ACCC website at www.accc.gov.au for additional information on your consumer rights.

 

Statement of Liability & Waiver

Words Publishing Pty Ltd T/A 4 Big Dogs, its subsidiaries, affiliates, service provides, employees, agents, officers and Directors does not accept liability for any loss arising from the purchase or use of any product/s purchased by you from our website.  You will waive and hold harmless the company, its subsidiaries, affiliates, service provides, employees, agents, officers and Directors from any claims/s resulting from any action taken by any of the foregoing parties or from the provision of any products.  Further, in respect of any books sold on this site, or blogs and information provided, we accept no responsibility for advice provided.  We strongly recommend that if you have a concern, you contact your professional veterinarian for advice, diagnosis or treatment.  Never disregard professional advice or delay in seeking advice from your veterinarian, because of something you have read on this website or in the book or information available from or on this website. 

 

Force Majeure

We cannot be held liable in any way by failing to perform any responsibilities or obligations, as defined in these T&Cs if such failure is the result of any factor which is outside its control, including acts of God. Acts of God include, but is not limited to fire, flood, earthquake, storm, hurricane or other natural disaster, war, invasion, revolution or insurrection, terrorism, government-imposed sanctions, pandemics, labour dispute, and interruption of telephone, electrical, or Internet services. In the event that any such Act of God occurs, you grant us a reasonable time to perform our services and obligations in accordance with these Terms and Conditions. 

 

Copyright & Trademark

Trademarks, images, special product names, slogans and logos appearing on this website are the property of us.  All rights are reserved and no other party without express written confirmation from 4 Big Dogs shall use such trademarks, images or logos.  You further agree to not ‘scrape’ data from our website for any purpose whatsoever.  You shall not introduce any virus, trojan horse, logic bomb, worm or other material which is malicious or is technologically harmful.  You shall not in any way attempt to interfere with the property working of our website. 

 

Inappropriate Content or Comments

You shall not upload, download, display, perform, transmit or otherwise distribute any content which is (a) libelous or defamatory (b) negative about us or the products we sell (c ) obscene, pornographic, abusive or threating  (d) encourages, advocates, advocators or partakes in activities that could constitute a criminal offence or in any way violates any local, state, national or foreign law or regulation.

We value and respect your privacy.  We are committed to protecting your privacy and complying with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (Privacy Act). 

We will collect your personal information (name, address, phone number, email) in the course of doing business with you and providing the product you have ordered.  We will keep this information confidentially; it will not be given or sold to any third party, other than in order to fulfil your product order; for example; provision of data to a courier company in order to deliver. 

We maintain appropriate administrative, physical and technical safeguards designed to protect your personal information.  That said, it is not possible to guarantee the security of information transmitted online; and you assume some risk with regard to security of information you provide through our website. 

Please note that our website uses cookies.  A cookie is a small file that is placed on your device if you allow it.  These cookies recognize your device when you visit our website.  this improves your experience and improves our website.  By allowing these cookies onto your device, you consent to receiving such communication, emails, message or remarketing from us.  At all times with any email marketing you can opt out or ‘unsubscribe’ by clicking on the unsubscribe button. 

For the purposes of remarketing, or website analytics, your data may be accessible by third parties, such as Google.  Please note that some such parties (such as Google) may have servers outside Australia.  To avoid such tracking, you may choose to search via the Incognito mode on your device. 

When you place your order, you agree to these T&Cs and to the storage, processing and use of the personal information provided to both ship your product and potentially to re-market you.  As mentioned, you can ‘opt out’ at any time. 

 

Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia and are subject to the jurisdiction Queensland, Australia.  

 

Amendments & Updates

These terms may not be changed unless we consent in writing to any such change and only by such authorized Director of the company.  We reserve the right to amend these T&Cs and should we do so, shall clearly publish such amendments on this website.
